NY court upholds age limit for judges

New York’s highest court shut down a challenge to the state’s mandatory judicial retirement age, according to the Times Union.

The Court of Appeals ruled that judges must still retire at the end of the year they turn 70, despite a 2024 constitutional amendment that added age to the state’s anti-discrimination protections. Three state Supreme Court justices had argued the amendment invalidated the age cap.

The court found that the retirement requirement remains part of New York’s constitutional framework and was not overridden by the newer amendment. Voters previously rejected a proposal to raise the retirement age to 80 in 2013.
