Burdett man sentenced after child was present during property damage incident

A Schuyler County man has been sentenced to jail and probation after being convicted of criminal mischief and endangering the welfare of a child in connection with a property damage incident at a residence in Burdett.

Chad A. Simmons, 47, was found guilty in Schuyler County Court on April 16 following a criminal mischief trial. He was convicted of third-degree criminal mischief, a Class E felony, and endangering the welfare of a child, a misdemeanor.

According to the Schuyler County District Attorney’s Office, Simmons damaged the front door and a window of a residence after being denied entry. Prosecutors said he kicked in the front door and threw an object through a window, causing damage to both. Authorities said Simmons knew a child was inside the residence when the incident occurred.

Judge Matthew C. Hayden sentenced Simmons on June 11 to six months in jail followed by five years of probation. The court also ordered him to pay $2,784.32 in restitution and issued an order of protection for the victim.

The case was investigated by the Schuyler County Sheriff’s Department and prosecuted by Schuyler County District Attorney Jeremy Hourihan.
