A Finger Lakes attorney accused of rape last year has been acquitted on all charges following a weeklong jury trial.
Thomas E. Plan, a Penn Yan-based lawyer, was found not guilty after jurors deliberated briefly at the conclusion of proceedings held in late March.
Plan had been indicted in August 2025 on charges of first-degree rape, a violent Class B felony, and third-degree rape, a Class E felony. Authorities alleged he engaged in sexual intercourse by forcible compulsion and without consent.
The case was prosecuted by Steuben County District Attorney Brooks Baker, who was appointed as a special prosecutor due to potential conflicts of interest. Seneca County Court Judge Barry L. Porsch presided over the trial. Plan was represented by Rochester attorney Mark Foti.
Following the verdict, Plan issued a statement expressing gratitude for the jury and those who supported him during the case.
Plan, who turned himself in after the indictment and was released on bail, continued practicing law while the case was pending. He works across the Finger Lakes region, focusing on criminal defense, immigration law, regulatory matters, and civil litigation.
