Multi-state lawsuit against U.S. Department of Energy appeal dismissed

A legal challenge involving New York and a coalition of states against the U.S. Department of Energy has been dropped at the appellate level, according to court filings.

Documents filed April 2 in the U.S. Court of Appeals for the Ninth Circuit show that all parties agreed to voluntarily dismiss the appeal, ending that phase of the case.

The stipulation, filed jointly by the states and federal officials, states that each side will bear its own legal costs and fees associated with the appeal.

The case included New York among a broad coalition of states and jurisdictions, along with several governors, who had challenged actions by the Department of Energy. Federal officials, including the energy secretary, were listed as defendants in the case.

No additional details about the underlying dispute or the reason for the dismissal were included in the filing.

The dismissal formally closes the appeal, though it does not necessarily resolve broader policy or legal disagreements tied to the original case.
