Penn Yan village officials denied two appeals tied to records requests about a proposed annexation during a special meeting March 2. The board also approved an agreement with the state Department of Transportation.
The appeals stemmed from requests by a resident seeking additional documents related to environmental review and utility impacts of the proposal.
Village Attorney Ed Brockman said the environmental review covered only the annexation because no formal site plans exist. Officials said the village had already provided 668 pages of records and recommended adding two court decisions that upheld the review process.
The board voted unanimously, with two members absent, to deny the appeal and uphold the original response.
In a second appeal, officials said they could not release certain electric system details for security reasons. They also said no additional records exist because the project remains conceptual.
Staff said they conducted an extensive search of available records and provided all materials used in considering the annexation. The board again voted unanimously to deny the appeal.
Board members also approved a resolution authorizing an undertaking agreement with the New York State Department of Transportation. The measure passed with the same vote count.
