Cayuga County DA says five convictions affirmed by appeals court

The Appellate Division, Fourth Department has affirmed convictions or sentencing decisions involving five Cayuga County defendants, District Attorney Brittany Grome Antonacci announced Friday.

The rulings, issued June 5 and June 26, leave in place cases involving false filing, a probation violation, family offense and contempt charges, and an attempted assault at Cayuga Correctional Facility.

On June 5, the court affirmed the convictions of Charles Grefer, who was found guilty by a Cayuga County Court jury on June 7, 2023, of two counts of offering a false instrument for filing in the first degree. Prosecutors said Grefer filed false paperwork with Cayuga County in 2021 while applying for director of community services. He was sentenced Aug. 21, 2023, to concurrent terms of two to four years on each count.

The court also affirmed the probation violation sentencing of Logan Livingston, who originally pleaded guilty in 2016 to rape in the second degree and was sentenced to six months in jail and 10 years of probation. Prosecutors said Livingston later violated probation after new arrests. He admitted the violation June 29, 2023, and was resentenced to three years in prison followed by 10 years of post-release supervision.

On June 26, the court affirmed the conviction of Tyrone Davis Jr., who was found guilty Jan. 25, 2024, of aggravated family offense, first-degree criminal contempt and second-degree aggravated harassment. Prosecutors said the crimes occurred in Auburn on April 16, 2023. Davis was sentenced April 30, 2024, to a total of two to four years.

The court also affirmed Raymond Decker's convictions on six counts of aggravated family offense and one count of first-degree criminal contempt. A Cayuga County Court jury found Decker guilty Sept. 28, 2022, in a case involving repeated violations of an order of protection in 2021. He was sentenced Jan. 5, 2023, to a total of 1 1/3 to four years.

The final affirmed conviction involved Darryl Bradshaw, who prosecutors said attacked a correction officer with a homemade weapon at Cayuga Correctional Facility on Oct. 16, 2022. Bradshaw pleaded guilty June 1, 2023, to attempted assault in the second degree and was sentenced Aug. 31, 2023, to two to four years.
