The family of Robert Brooks, who died at Marcy Correctional Facility in December, plans to announce a civil rights lawsuit on Wednesday. Brooks, 43, died after an altercation captured on body camera footage, showing correction officers hitting him while restrained.
He succumbed to his injuries, which included facial bruises and a fractured nasal bone, the day after the incident.
Advocates and Citizen Action of New York will hold a rally Tuesday outside the facility. Over a dozen correction workers were suspended without pay, and one resigned before suspension.
Brooks was serving a 12-year sentence for a 2016 stabbing. Activists and lawmakers are now urging the prison’s closure.
