Sodus Point wins land-access dispute in village

The village of Sodus Point has prevailed in a land-access dispute against Guy and Kathy Berretta, who installed a fence blocking a public right-of-way.

On April 25, New York State Supreme Court Judge Rick Healy dismissed the Berrettas’ lawsuit on procedural grounds, according to reporting this week by The Finger Lakes Times.


The conflict centered on a strip of land behind the Berrettas’ bayside property on Wickham Blvd. The village claimed this land was a long-established public pathway connecting downtown to the lakefront.

Judge Healy’s ruling also granted the village a permanent easement through eminent domain proceedings.
