Penn Yan trustees will discuss how to proceed with a Liberty Street water project after the village received a single construction bid of $895,055, about $227,000 above the construction funding listed in its capital plan.
The Village Board will take up the bid during a special meeting at 8 o'clock Monday morning in Room 202 of Village Hall, 111 Elm Street.
The project would transfer water services from a 6-inch main to a 10-inch main along Liberty Street between Chapel Street and North Avenue. Village materials say the work needs to be completed before the state Department of Transportation paves Liberty Street in 2027.
Bid exceeds listed construction funding
Nardozzi Paving & Construction LLC submitted the only bid, according to a tally sheet included with the meeting packet. The Geneva company acknowledged three addenda and submitted the forms identified on the tally sheet.
The village's water capital plan lists $314,314 for Liberty Street construction in the 2025-26 fiscal year and $353,586 in 2026-27, for a combined construction allocation of $667,900. The $895,055 bid is $227,155 higher, or about 34% above that amount.
The plan also lists $31,431 in engineering expenses for the project. The special meeting agenda describes the item as a discussion of the Liberty Street water-service transfers, the budget and bids received, and does not indicate that trustees are scheduled to award the contract.
Electric boundary records appeal
Trustees will also consider an appeal filed by Jeremy Hughes over the village's response to a Freedom of Information Law request concerning the electric-service franchise boundary between Penn Yan Municipal Electric and New York State Electric & Gas Corp.
The request concerns the boundary affecting tax parcel 49.03-1-15.111 on or near Sand Hill Road in the town of Jerusalem. Hughes said the village provided a historic 1942 franchise map, a surveyor's scaled overlay and other mapping exhibits, but he is seeking additional records or a clearer determination about whether other records exist or were withheld.
His appeal asks the village to produce any additional responsive records, identify records withheld and the legal exemption used, or expressly state when no responsive records exist. The agenda lists the matter as a FOIL appeal and does not state what determination the board may make.
Recruitment update also planned
The board is scheduled to receive an update on recruitment for a heavy equipment operator. No additional recruitment details are included in the agenda.
The meeting will begin with time for public requests and comments. Trustees may also enter an executive or closed session with legal counsel before comments and adjournment.
