A Seneca Falls man was charged with driving while intoxicated after Waterloo police said he tried to avoid a traffic stop and later recorded a blood alcohol content of 0.13%.
Zachary J. Herman, 34, was arrested around 11:04 p.m. Sept. 12 after police attempted to stop a vehicle they said was being driven without a valid inspection.
Police said Herman pulled into a driveway, turned off the vehicle’s lights and got out of the driver’s seat while a passenger climbed into the driver’s seat from the passenger side.
Officers determined Herman was intoxicated and that his New York driver’s license was suspended, according to police.
Herman later provided a breath sample that police said showed a blood alcohol content of 0.13%.
He was charged with driving while intoxicated, driving while intoxicated with a blood alcohol content of 0.08% or greater, and third-degree aggravated unlicensed operation.
Police also issued traffic tickets for operating an uninspected motor vehicle and having an open container.
Herman was released on uniform traffic tickets and is scheduled to appear in Fayette Town Court at a later date.
