Village of Penn Yan board to consider tax cap waiver, utility actions on Tuesday

The Penn Yan Village Board is scheduled to consider a proposed tax cap waiver, multiple municipal utility actions, personnel matters and infrastructure-related items when it meets Tuesday.

Among the key items on the agenda is a proposed resolution to set a public hearing on a local law that would establish a New York State tax cap waiver for the 2026–2027 village budget. The resolution states the village does not anticipate exceeding the state-mandated 1.02% tax cap but seeks a waiver due to the complexity of the law and potential penalties for noncompliance. A public hearing on the proposed local law is scheduled for Feb. 17 at 6 p.m. at Village Hall if the resolution is adopted.

The board is also scheduled to consider a resolution initiating the State Environmental Quality Review Act process for the proposed adoption of an updated Village Code. The action is classified as a Type I action, requiring a Full Environmental Assessment Form, and includes a notice of intent for the village to act as lead agency for the review. Trustees are expected to review Part 1 of the FEAF during the meeting.


The Municipal Utilities Board is bringing 14 motions forward for board approval. These include authorizing electric account write-offs totaling $8,343.52 across 25 accounts, approving a $19,500 change order for commissioning regulators and additional transformers, and declaring various electric, water and sewer items surplus for disposal, sale or scrap.

Trustees are also scheduled to consider approval of annual safety training courses for electric department staff, declaring five fire hydrants surplus for sale for ornamental use only, and authorizing the sale of surplus sewer and water equipment. A motion is included to approve sewer charge forgiveness in the amount of $118.37 for a property at 5 Pleasant Ave. following a verified hot water tank failure.

Additional utility-related items include authorizing staff training and certification courses, approving professional memberships, accepting a contract reduction related to a flow splitter box project, awarding a vehicle bid for the Water/Sewer Department, and accepting payment agreements totaling $10,282.55.

In administrative matters, the board is scheduled to vote on a mileage allowance resolution aligning reimbursement with the IRS rate effective Jan. 1, 2026, approve a retroactive seasonal recreation supervisor appointment, and authorize a budget amendment for the 2025–2026 fiscal year. Trustees will also consider engagement letters for bond counsel services related to water treatment plant improvements and legal representation in an ongoing lawsuit.

Public safety items include a proposed change to the Planning Board meeting start time, personnel actions within the Fire Department, and declaring a surplus police vehicle for sale. Reports from the code enforcement officer, police chief and fire chief for December 2025 are also on the agenda.

The Public Works Committee is scheduled to provide an update on Downtown Revitalization Initiative items, including Lake Street Park naming, and to discuss a municipal parks and recreation grant. Trustees will also consider authorizing a grant application for a new trailhead at the Elm Street Sports Complex, signing a letter of commendation, and approving the sale of a white oak tree at the cemetery.

Public comments, committee reports and other business are also listed on the agenda. The meeting is set for 6 p.m. in Room 202 at Village Hall, 111 Elm St.
