Courtroom incident leads to charges in Penn Yan

Police arrested a man after a disruption inside Penn Yan Village Court led to his removal from the courtroom.

Brian E. Swinehart, 45, of Penn Yan was taken into custody Dec. 22 after police said he acted contemptuously during court proceedings. Officers reported that Swinehart displayed insolent and disruptive behavior in front of the Village Justice, the Yates County District Attorney, and others in the courtroom.


Police removed Swinehart from the courtroom and walked him to the Penn Yan Police Department. Officers said he continued the behavior after arriving at the department. Swinehart was charged with criminal contempt in the second degree and later released on an appearance ticket. He is scheduled to appear in Penn Yan Village Court at a later date.
