Senator Kirsten Gillibrand has applauded the American Bar Association’s (ABA) endorsement of implementing the Equal Rights Amendment (ERA) to the U.S. Constitution. In a statement issued on August 6, Gillibrand highlighted the significance of the ABA’s support, emphasizing that the association’s backing signals that constitutional law experts believe the ERA meets all Article V requirements for certification and publication.
“The ABA’s endorsement is a significant validation,” said Gillibrand. “This step would enshrine freedom and equality for American women and girls into the Constitution, providing a robust counter to the Dobbs decision.”
Gillibrand’s 2023 ERA Now resolution directs U.S. Archivist Colleen Shogan to affirm the ERA as the 28th Amendment, certify state ratifications, and publish it in the Federal Register. The resolution asserts that the ERA has fulfilled the constitutional requirements, including its passage by two-thirds of Congress in 1972 and ratification by three-quarters of the states.
