Police say a 22-year-old Phelps man used a knife to assault his 30-year-old brother in an incident that happened in the drive-thru lane at McDonald’s in the City of Canandaigua.
On Saturday around 1:15 a.m. a fight broke out between the two males inside a vehicle, which was moving through the drive-thru lane of McDonald’s.
When police responded they learned that Tristin A. Elliott, 22, of Phelps used a knife to assault his brother, Justin, who is also a Phelps resident.
Justin Elliott suffered minor lacerations to his hand, neck and stomach during the fight.
When police arrived – they say Tristin threatened to harm one of the officer’s with the knife.
Tristin Elliott was charged with second-degree assault, and criminal obstruction of breathing. He was charged with menacing for threatening the police officer.
Elliott was held at the Ontario County Jail.
Police say Justin Elliott received treatment and was also charged with obstructing governmental administration. He was issued appearance tickets.
