Appeals court revives Elmira Prison abuse claim

A prison assault case just took a sharp turn, with new allegations back in play, according to the Times Union. Judges ruled a trial court should’ve considered claims that guards at Elmira Correctional Facility sexually assaulted an inmate during a violent incident.


The man already won $30,000 after accusing officers of beating him in 2016. But the lower court excluded claims that guards shoved an object into his rectum. An appeals panel said that alleged act could still fall under excessive force tied to their duties.

The ruling sends the case back to the original judge, who now must decide whether to revisit damages or hold another hearing on the added claim.
