Rochester man arrested on assault, criminal mischief charges tied to Tyre incident

A Rochester man was taken into custody this week on an outstanding warrant tied to an alleged assault and property damage incident in the Town of Tyre.

Seneca County Sheriff Tim Thompson said deputies arrested 67-year-old Phillip Forte on April 16 after coordinating a custody transfer with the Monroe County Sheriff’s Office, which had him in custody on unrelated charges.

Investigators said Forte was wanted on a Seneca County warrant charging him with third-degree assault and fourth-degree criminal mischief, both misdemeanors. The charges stem from an altercation in May 2025 at a local business in Tyre.

Authorities allege Forte caused physical injury to another patron during the incident and damaged the victim’s cell phone.

Forte was taken into custody without incident, transported to the Seneca County Law Enforcement Center for processing, and then turned over to correctional staff to await arraignment in CAP Court.
