Seneca County sheriff's deputies charged a driver with two misdemeanor counts of driving while intoxicated after a traffic stop in the town of Tyre early Saturday.
Deputies said they stopped Damian Hartt of Ellershouse, Nova Scotia, at about 12:11 a.m. Sept. 26 after seeing a vehicle traveling 20 mph over the posted speed limit, according to the Sheriff's Office release.
Hartt was charged with common-law DWI and a separate blood-alcohol-based DWI count, the release said. The Sheriff's Office reported a breath test result of 0.08% while describing the second charge as involving a concentration greater than 0.08%.
He was processed at the Seneca County Law Enforcement Center and released on appearance tickets. The release did not give a court date.
