Rochester man pleads guilty to new federal child pornography charge

A Rochester man already convicted on a state child pornography charge has now pleaded guilty to a new federal offense after authorities found hundreds of illegal files on his phone while he was on probation.

Marcobrien S. Volcy, 28, entered a guilty plea Thursday before Chief U.S. District Judge Elizabeth A. Wolford to possession of child pornography following a prior conviction, a federal offense that carries a mandatory minimum of 10 years in prison and up to 20 years, along with a possible $250,000 fine.

According to prosecutors, Volcy had already pleaded guilty in August 2023 in Monroe County Court to possessing a sexual performance by a child under 16, for which he received a 1-to-3-year prison sentence.

Then, on January 19, 2024, while still on New York State probation, Volcy was found in possession of a cellphone containing more than 650 images and videos of child pornography. Some of the content involved prepubescent children.

The case was investigated by the Federal Bureau of Investigation under Acting Special Agent-in-Charge Mark Grimm and falls under the DOJ’s Project Safe Childhood initiative.

Sentencing is set for January 14, 2026, before Judge Wolford in Rochester federal court.
