A photographer out of Elmira is suing Attorney General Letitia James over having her right to deny same-sex couples service.
Owner Emilee Carpenter believes her inability to choose not to serve LGBTQ+ couples for wedding photos goes against her religious beliefs and constitutional rights.
Out of precaution for herself, she has filed the lawsuit in an attempt to not be penalized for not following the anti-discrimination laws set out by state agencies.
If she was penalized, the fines are up to $100,000, a year in jail, and the revocation of a business license.
While the case is pending, New York cannot enforce its laws against Carpenter.
