New York’s body armor ban struck down, with appeal window open

A federal judge ruled New York’s body armor ban unconstitutional but delayed the ruling for 14 days to allow an appeal, according to Spectrum News.

U.S. District Judge John Sinatra found the restriction violates the Second Amendment.

Two people who wanted to purchase body armor for self-defense challenged the law.

The state enacted the ban after the 2022 Buffalo Tops supermarket shooting, in which a gunman wearing body armor killed 10 Black people and injured three others.

The state attorney general’s office said it is reviewing the decision.
