An Auburn man was charged with felony criminal mischief Wednesday after deputies said he damaged a cellphone during a domestic incident in the town of Tyre.
Juan F. Atilano, 36, was arrested around 5 a.m. July 22 and charged with third-degree criminal mischief, a Class E felony, according to the Seneca County Sheriff's Office.
Deputies alleged that Atilano intentionally damaged a cellphone he did not own during the incident, which also occurred July 22.
Atilano was taken to the Seneca County Law Enforcement Center for processing before being transferred to the county Corrections Division.
He was scheduled to be arraigned at 7 p.m. Wednesday in Seneca County Centralized Arraignment Part Court. The charge is an allegation, and Atilano is presumed innocent unless proven guilty in court.
