A Branchport man was charged with DWI after Penn Yan police said his vehicle swerved off the road and nearly hit trash cans on Seneca Street.
Police said Christopher M. Egburtson Jr., 27, was stopped Tuesday on East Elm Street after officers saw the vehicle leave the roadway, nearly strike trash cans and fail to signal a turn within 100 feet.
Officers said they observed signs of intoxication during the stop and found an open beer can in the center console.
Egburtson was taken to the Yates County Jail, where police said a breath test showed a blood alcohol content of 0.13%.
He was charged with DWI, DWI with a blood alcohol content of 0.08% or higher, insufficient turn signal, moving from lane unsafely and consumption of alcohol in a motor vehicle.
Egburtson was released on traffic tickets and is scheduled to appear in Penn Yan Village Court at a later date.
