An investigation into a December disturbance in Penn Yan ended with a felony firearm charge.
James M. Gerard, 72, of Penn Yan, was arrested Feb. 21 at about 6:44 p.m. and charged with criminal possession of a firearm, a Class E felony.
Police said officers responded to a residence in the village on Dec. 27 for a possible disturbance and found Gerard in possession of an unregistered pistol without a permit. Gerard told officers at the time that the pistol was not capable of firing.
The pistol was seized as evidence. A police firearm examination later determined the weapon was operational, according to investigators.
Police made contact with Gerard on Feb. 21 and took him into custody. He was released on an appearance ticket and is scheduled to answer the charge in court at a later date.
