House repeals hidden lawsuit clause in shutdown bill

The House voted to repeal a surprise provision allowing senators to sue the government, according to the Associated Press.


Tucked into the bill that reopened the government, the clause let senators seek up to $1 million if the DOJ seized their phone records without warning. Lawmakers say they didn’t know it was included. The Senate added it after a special counsel subpoenaed records from several Republicans tied to the 2020 fake elector probe.

Some senators, like Lindsey Graham, still support the right to sue—but the Senate hasn’t said if it’ll take up the House’s repeal.
