Chick-fil-A proposal debated among Victor ZBA: What’s next?

Zoning issues took center stage in Victor on Monday as the town’s Zoning Board of Appeals reviewed proposals ranging from a new Chick-fil-A location to a small dog kennel business on Route 96. The board postponed final decisions on both applications, opting instead for more review and a site visit in one case.

Dog kennel proposal delayed pending site visit

Applicant Mary Duerr, representing Bow Wow Bakery and Bath, sought relief from the two-acre minimum lot size requirement to operate a dog kennel at 7235 State Route 96. The parcel is 1.055 acres. Duerr said she plans to build an indoor-only kennel for a maximum of 20 dogs, with soundproofing and odor control measures in place.

Several residents spoke during the public hearing, expressing concerns about noise, proximity to residential areas, and property value impact. Duerr noted that no outdoor runs were planned and that dogs would only be walked on-leash by staff.

Board members expressed interest in better understanding the site layout and surrounding uses. They scheduled a site visit for Saturday, Sept. 21 at 9 a.m. and agreed to continue the public hearing at the next meeting.


Chick-fil-A requests multiple variances for new restaurant project

Representatives from Bohler Engineering and Chick-fil-A presented an extensive list of variance requests for a proposed standalone Chick-fil-A restaurant at 7979 Pittsford Victor Road, located within the existing Eastview Mall development. The requests included:

  • Reduction in required open space from 35% to 34.3%.
  • Approval for placing accessory structures — including a meal delivery canopy, drive-thru canopies, and a 4-foot fence above a retaining wall — in front of the principal building.
  • A waiver for not installing a sprinkler system under the drive-thru canopies.
  • Permission to use floodlights for flagpole lighting instead of narrow-beam spotlights.
  • Signage variances, including approval for multiple building-mounted signs on elevations not adjacent to a public right-of-way, and a third monument sign 35 feet from Route 96.

Representatives stated the variances are necessary to meet operational and branding standards while adapting to site constraints. They emphasized that Chick-fil-A has incorporated traffic mitigation and landscaping features in the plan.

The board tabled the application to allow time for review of revised drawings and feedback from the Planning Board, which is reviewing the site plan concurrently. The matter is expected to return for further discussion at a future meeting.

Next meeting

The Zoning Board of Appeals will reconvene on Tuesday, Oct. 1, at 7 p.m., when the public hearing on the Bow Wow application is expected to continue.
