Mask crime law stalls budget progress in Albany

New York’s overdue state budget remains in limbo as lawmakers struggle to reach agreement, and Gov. Kathy Hochul’s controversial face mask crime proposal is emerging as a key stumbling block.

While legislative leaders say they’re close to a deal, Hochul’s plan to enhance penalties for crimes committed while wearing a mask has reignited debate. Lawmakers are divided over civil rights concerns, religious freedoms, and how the measure could be interpreted amid national tensions. Some suggest tying the proposal to sentencing enhancements, similar to hate crime laws.

Another source of friction is Hochul’s push to expand prison “merit time” credits. While the original plan included some violent offenders, resistance has likely narrowed eligibility, leaving its future uncertain.
