Former Erie County DSS worker admits to stealing HEAP benefits

A former Erie County Department of Social Services employee has admitted to stealing nearly $5,000 in public assistance funds, using her position to divert heating benefits intended for low-income families to properties she owned.

Denise Nelson, 56, of Buffalo, pleaded guilty in Erie County Court to one count of Attempted Grand Larceny in the Third Degree, a class E felony. Judge Sheila A. DiTullio accepted the plea. As part of the agreement, Nelson repaid $4,917 to the county, National Grid, and National Fuel Gas.


An investigation by the New York State Office of the Welfare Inspector General found that Nelson, while employed by the county’s social services agency, manipulated the Home Energy Assistance Program (HEAP) system to redirect funds meant for others. Without their knowledge, she rerouted benefits in their names to pay utility bills on properties she owned.

“Instead of helping vulnerable New Yorkers, Ms. Nelson exploited her position for personal gain,” said State Welfare Inspector General Lucy Lang. “This case underscores our unwavering commitment to holding those who abuse public resources accountable.”

The investigation began after a referral from the county’s Department of Social Services. Inspector General Lang credited multiple team members and praised the department for its cooperation and swift referral. Erie County District Attorney Mike Keane also thanked investigators and said the case showed his office’s resolve to pursue those who commit benefit fraud.

“This program is reserved for low-income individuals and families who truly need help paying for their home utilities,” Keane said.

Nelson has since been terminated from her position at the Erie County DSS.
