President-elect Donald Trump is attempting to postpone his January 10 sentencing for his hush money conviction, arguing that his presidential immunity claim must be resolved first.
Trump’s lawyers filed an appeal, asserting that sentencing should automatically pause while higher courts review immunity arguments. They claim immunity protections extend into the presidential transition period and accuse prosecutors of political motivation.
While Justice Juan Merchan previously ruled against immunity claims, he indicated Trump would likely receive an unconditional discharge, avoiding prison time. The Manhattan District Attorney’s Office is expected to respond to Trump’s motion shortly.
