The Town of Niles Board of Appeals held a public hearing on December 5, 2024, and unanimously approved a building setback variance for an erosion control project at 75 Woodlot Landing. The meeting, presided over by Acting Chairperson Elaine Axton, took place at Niles Town Hall in New Hope, New York.
The variance application, identified as Case NV2024-3, was submitted to address the need for erosion control along a cliff face overlooking the property. The applicant’s representative, Tyler Dixon, explained that the project would stabilize the area by anchoring new stairs and a deck into the cliff wall to prevent further erosion. Dixon also presented plans and photos, noting that the land is currently unstable and requires terracing and landscaping to protect both the property and Owasco Lake.
The board approved the applicant’s request for relief from Section 164.8.B of the town’s building setback law, which mandates a minimum 15-foot distance from adjacent property lines. The variance allows the structure to be built closer than the standard requirement.
The motion to approve the application was made by board member Patrick Murray and seconded by Ronald Rybak. The decision passed unanimously with votes from Axton, Murray, and Rybak. A Notice of Action will be forwarded to the applicant.
