The New York State Department of Environmental Conservation (DEC) has issued a draft permit modification for Corning Incorporated’s Erwin Manufacturing Complex, allowing the facility to discharge stormwater into the Tioga River. The agency is inviting public comments on the proposal until December 13.
The updated permit under the State Pollutant Discharge Elimination System (SPDES) reflects significant changes. Outfalls 001 and 01A, previously used for wastewater discharge, have been closed, with wastewater now being processed at the Town of Erwin Wastewater Treatment Plant. Other updates include administrative revisions, corrections to waterbody classifications, and modifications to chemical usage protocols.
The Tioga River, classified as a Class C waterbody, is designated primarily for fishing and non-contact recreational use. DEC officials noted that the updates aim to enhance environmental protections while ensuring compliance with industrial discharge standards.
The DEC confirmed the project is exempt from environmental reviews under the State Environmental Quality Review (SEQR) process, categorizing it as a Type II action. Additionally, it is not subject to State Historic Preservation Act or Coastal Management reviews.
Public comments and requests for a hearing must reference the SPDES permit number NY0107221 and be submitted in writing to Ashley Rubacha at NYSDEC Region 8 Headquarters. The draft permit and supporting documents are available online and for in-person inspection by appointment.
