Wayne County Treasurer Patrick Schmitt has filed a lawsuit against Dollar General on behalf of the estate of Donna Porter, who died in January 2022 after slipping on a sidewalk at the Rose store.
Filed on June 13, the lawsuit claims Porter, 83, slipped on a dangerous condition on January 7, resulting in a fatal head injury. The suit alleges Dollar General’s negligence in maintaining the sidewalk caused the accident.
As the county’s public administrator, Schmitt is responsible for handling estates when no one else can. His attorney, Matthew St. Martin, said they are pursuing this claim to ensure the estate’s debts are paid and any remaining funds go to Porter’s beneficiaries.
