A group of individuals, including those who initially planned to apply for dispensary licenses and doctors who believe the medical cannabis program has been neglected, has filed a new lawsuit against the New York State Office of Cannabis Management (OCM).
The lawsuit questions the office’s authority to set policy, arguing that regulations should originate from the state Legislature. The group is requesting that a judge open dispensary applications to all applicants, not just those with justice-involved backgrounds. Additionally, they are calling for the state to increase enforcement of illegal sales.
On Thursday, another adult-use retail dispensary opened in Ithaca, making it the second adult-use dispensary to open in upstate New York this year, following one in Binghamton last month.
