Cuomo threatens lawsuit if federal plan to distribute COVID-19 vaccine doesn’t change soon

Governor Andrew Cuomo is promising litigation if the Trump Administration blocks a vaccine from New York State.

“Any plan that intentionally burdens communities of color to hinder access to the vaccine deprives those communities of equal protection under the law,” Cuomo said in New York City on Sunday.

The Trump distribution plan uses drug stores, hospitals, and other health care providers to help distribute. However, Governor Cuomo says that the infrastructure isn’t equal in those communities of color.

“That is the same infrastructure that doesn’t exist in the communities we’re talking about. It’s the same infrastructure that was lacking that caused the health care disparities in the first place, that caused the higher infection rate in the Black and Brown community, that caused the reduced testing rate in black and brown community,” Cuomo said.

He’s calling for swift change to the plan.

“If the Trump administration does not change this plan and does not provide an equitable vaccine process, we will enforce our legal rights,” Cuomo added. “We will bring legal action to protect New Yorkers.”

Meanwhile, President Donald Trump said on Friday that he wouldn’t allow distribution of a vaccine to New York if it isn’t delivered to all of its people immediately. Governor Cuomo has been critical and skeptical of Trump’s role in pushing a vaccine along too quickly.
