The New York State DEC has filed a lawsuit against the International Joint Commission, claiming negligence stemming from high water levels on Lake Ontario.
The lawsuit alleges the IJC’s “Plan 2014” resulted in devastating flooding for communities and residents along the lake’s shoreline in 2017 and 2019.
“The persistent high water levels – and the devastation they have caused to State property, including that of the DEC – are the direct result of the International Joint Commission’s tortious mismanagement of Lake Ontario’s water levels,” the lawsuit reads. “The IJC must answer for its wrongful conduct.”
During a visit in Rochester last week, Governor Andrew Cuomo announced the lawsuit was forthcoming.
