Judge seeks more filings in challenge to James’ Cornell investigation

A judge has given attorneys another week to submit arguments in a challenge seeking Attorney General Letitia James’ removal as special prosecutor in the Cornell sexual assault investigation, according to Spectrum News.

Acting Supreme Court Justice James Farrell questioned whether the Sullivan County proceeding could move forward without participation from the other six men accused in the underlying civil lawsuit.

Attorney Andrew Miltenberg argues that James demonstrated bias through a sympathetic social media post about the woman who alleges she was sexually assaulted at a fraternity house in October 2024.

James’ office disputes that argument and has asked the court to reject the challenge as procedurally defective and without merit.

Gov. Kathy Hochul appointed James on Oct. 1 to take over the investigation from Tompkins County District Attorney Matthew Van Houten, who previously declined to bring charges.
