A Wayne County judge upheld a state decision certifying United Farm Workers as the union for laborers at Wafler Farms, according to the Finger Lakes Times.
Judge Rick Healy ruled the state labor board acted “properly” in certifying the union, which the farm has resisted since 2022. Wafler Farms argued H-2A guest workers couldn’t unionize and refused to negotiate or attend arbitration hearings.
The case stems from New York’s 2019 law granting farmworkers rights like unionizing and overtime pay.
