Rochester man arrested for DWI after Penn Yan hit-and-run

Penn Yan Police arrested a Rochester man following a hit-and-run crash at a local business on Tuesday.

Robert B. Foley, 67, was charged with driving while intoxicated, possessing an open container of alcohol, and leaving the scene of a property damage accident.

According to police, a witness provided a description of Foley’s vehicle and direction of travel. Officers located the vehicle shortly after in the parking lot of another village business. Foley showed several signs of intoxication and had an open container of alcohol in the vehicle.

After failing field sobriety tests, Foley was arrested and taken to the Yates County Jail, where he refused a chemical breath test. He was later processed at the Penn Yan Police Department and released with tickets to appear in village court.
