Finger Lakes judges sue to overturn NY’s judicial retirement age

Two Wayne County judges are suing to strike down New York’s mandatory retirement age for judges, citing new protections under the state’s Equal Rights Amendment, according to the Finger Lakes Times. They argue the law now prohibits age-based discrimination.


Judges Rick Healy and Art Williams claim the retirement rule violates updated constitutional protections that took effect in January. Their lawsuit seeks to allow judges to serve beyond age 70. Arguments are set for June 4, with state and election officials named in the suit.

Republican judicial candidate Jeannie D’Alessandro is seeking to intervene, saying the challenge could derail her candidacy and disrupt elections statewide.
