The Penn Yan Police Department arrested Spencer J. McSain, 33, on March 21 at 11:03 p.m. after officers observed his vehicle had an expired inspection. During the stop on Liberty Street, police noted signs of intoxication and conducted field sobriety tests, which McSain failed.
McSain was taken into custody and transported to the Yates County Jail, where he voluntarily submitted to a chemical breath test. His blood alcohol content registered at 0.05%. He was charged with driving while ability impaired by alcohol and operating an uninspected motor vehicle.
McSain was issued traffic tickets and is scheduled to appear in Penn Yan Village Court at a later date.
