DEC releases draft permits for streamlined activities in wetland areas

The New York State Department of Environmental Conservation has issued five new draft general permits and revisions to two existing permits to streamline projects in state-regulated freshwater wetlands and protected waterbodies. The announcement by Interim Commissioner Sean Mahar on February 5 follows the implementation of updated wetlands regulations aimed at safeguarding an additional one million acres of critical wetland habitat.

The proposed permits are designed to simplify the application process for activities including solar energy projects, housing developments, shoreline erosion protections, and utility infrastructure maintenance. Public comments on the drafts will be accepted until March 14, 2025.

“Protecting New York’s critical wetlands continues to be a collaborative process involving valuable public and stakeholder input,” said Mahar. He emphasized that the new permits balance environmental protection with economic and renewable energy development.


The permits cover a range of projects:

  • Community-Scale Solar Energy Installations (GP-0-25-004): Authorizes road and power line construction, vegetation clearing, and mitigation efforts.
  • Electric Utility Right of Way Maintenance (GP-0-25-005): Permits temporary access roads, infrastructure repair, and vegetation control.
  • Natural Gas Utility Right of Way Maintenance (GP-0-25-009): Similar to the electric utility permit but focused on gas infrastructure.
  • Housing Development (GP-0-25-006): Allows construction of various residential structures and outlines mitigation requirements for permanent wetland impacts.
  • Lakes and Shorelines (GP-0-25-007): Authorizes shoreline protections, dock repairs, boat ramp installations, and maintenance dredging.
  • Invasive Species Management (GP-0-25-008): Expands existing permits to include additional methods of invasive species control.
  • Stream Crossing for Timber Harvest (GP-0-23-004 and GP-0-23-005): Adds freshwater wetland authorization to timber-related projects.

Wetlands play a crucial role in biodiversity conservation, water quality improvement, flood mitigation, and carbon sequestration. The updated regulations, effective January 1, aim to clarify the status of smaller, ecologically significant wetlands and provide a streamlined classification and appeals process.
