Canandaigua man pleads guilty to transferring obscene material

A local man will be headed to prison after new action in court. Preston Herbst of Canandaigua pleaded guilty in U.S. District Court in Rochester for transferring obscene material. The plea follows his previous 36-month prison sentence received last July for possession of child pornography.


In a troubling development, after his sentencing but prior to his incarceration, Herbst was found to have uploaded child pornography to the Snapchat platform. The National Center for Missing and Exploited Children reported the activity in September, which led to a federal investigation. Search warrants executed in October and November confirmed that Herbst had used his Snapchat account to trade child pornography while under the supervision of United States Probation and in violation of his release conditions.

Herbst now faces up to five additional years in prison and a $250,000 fine. His sentencing is scheduled for September, concluding an investigation led by the Federal Bureau of Investigation.
