Court rules in favor of Victor in Lord & Taylor eminent domain case

  • Staff Report

The New York State appellate court has ruled in favor of the town of Victor, granting it eminent domain rights to acquire the vacant Lord & Taylor space in Eastview Mall.

RochesterFirst.com reports the decision ends over a year of legal disputes between the town, the mall developer Wilmorite, and Hudson’s Bay Company (HBC), the parent company of the now-bankrupt Lord & Taylor.

A new appraisal will come next for the space, which has been empty since 2021.

The town of Victor and Wilmorite have proposed redeveloping the 90,000 sq. ft. area into three new sections: a large retail space for an eco-friendly retailer, a family-owned grocery store, and a municipal space for community use, pending approval from the town board.
