Past and present employees of Mirbeau Inn & Spa in Skaneateles received payments after the New York State Department of Labor investigated the resort’s gratuity policy. However, several employees expressed dissatisfaction with the investigation’s limited time period, resulting in “frustratingly small” payments.
One such employee recently spoke with The Citizen about the investigation and violations.
Heather Farr, a former massage therapist at the resort, discovered that the spa’s policy violated state labor law, which prohibits employers from retaining any part of an employee’s gratuity. She filed a complaint with the Department of Labor in early 2018.
The department’s investigation spanned 2018 to 2021, but employees like Farr argue that it neglected several years when the policy was in place. Mirbeau Inn & Spa changed the policy in September 2018.
Employees hope to reopen the investigation into the Skaneateles resort with a longer time period, as the received payments do not accurately represent the full amount they believe they are owed for working under the policy.
