The investigation revealed that Osorio was caring for his 4-month-old daughter at their residence when he became upset with the child’s crying and began shaking her for about three minutes. He then threw the child into a baby swing and drove her to the Carthage Area Hospital, where she was diagnosed with a subdural hematoma and subarachnoid hemorrhage.

The victim was transported to Upstate Golisano Children’s Hospital in Syracuse and was listed in stable condition. Osorio was arraigned in Jefferson County CAP court and granted pre-trial release.

Reckless assault of a child is defined as a person over the age of 18 causing serious physical injury to a child under 5 years old by shaking or throwing the child so as to impact their head on a hard surface or object.
