Wayne County judge dismisses sex abuse case citing insufficient evidence, DA disagrees

A sex abuse case involving a 51-year-old Sodus man has been dismissed in Wayne County Court.

Robert Olmstead, 51, of Sodus had been charged with criminal sex act after alleged abuse of a 10-year-old girl.

Officials with Wayne County Child Protective Services had noted that Olmstead had oral sex with the girl, whom he was caring for in July 2012 at his home in Palmyra.

Following the dismissal by the Wayne County judge, District Attorney Mike Calarco told WHEC-TV that the case was dismissed due to insufficient evidence.

He didn’t agree with that assessment of the case.
