A Wayne County man convicted of possessing child pornography has violated his probation – twice – but is still allowed to live within feet of the front entrance of an elementary school.
"The alleged perpetrator has all the rights and the victims in the community have none," said Sheriff Barry Virts.
When the FBI raided Renny Graham's house in September 2018 looking for child pornography, it was in full view of children boarding the bus at Marion Elementary School. After serving time in federal prison, Graham was allowed to return to his home.
"I don' t think that's okay," said Sabrina Macauley who routinely walks by the school on her lunch hour. "I thought there was a certain distance you had to be from a school."
There are no restrictions for sex offenders who have completed their probation or parole. Graham is on federal probation, yet the office says New York State does not allow for restrictions as to where released federal offenders can live. Other exemptions are made for offenders returning to a home they own.
