Penn Yan woman accused of burglary after refusing to leave closed Bath store

A Penn Yan woman was charged with burglary after police said she refused to leave a closed Bath supermarket and consumed merchandise she had not paid for.

Village of Bath police said officers were called to Tops Friendly Markets at 309 West Morris St. around 12:17 a.m. Thursday, Nov. 5, for a woman remaining in the store after closing.

Employees told officers they had repeatedly advised the woman that the store was closed, she could not make a purchase and she needed to leave the property.

Police identified her as Leah Brady, 41, and said officers found her eating unpaid merchandise.

She physically resisted officers’ attempts to take her into custody, resulting in a brief struggle, according to police.

Brady was arrested without further incident and charged with third-degree burglary, a Class D felony, along with petit larceny and resisting arrest, both Class A misdemeanors.

She was processed and taken to the Steuben County Jail for centralized arraignment, where police said she was held without bail.

Police also said Brady had two prior felony convictions in New York.
