A federal appeals court has partially revived a Skaneateles parent’s lawsuit accusing the school district of allowing her child to socially transition without her consent, according to The Citizen.
The Second Circuit sent part of Jennifer Vitsaxaki’s case back to federal district court after finding that a recent U.S. Supreme Court ruling could affect her claims.
Vitsaxaki alleges the district violated her parental and religious rights by using a different name and pronouns for her child and providing LGBTQIA support and transition-related resources.
The appeals court upheld portions of the earlier dismissal but allowed her damages claims to be reconsidered.
The Skaneateles school district has argued that its policies follow state Education Department guidance and has otherwise declined comment on the lawsuit.
