The Penn Yan Village Board will take up two Freedom of Information Law appeals and consider an agreement with the state during a special meeting at 12:30 p.m. today.
Trustees are scheduled to meet in Room 202 at Village Hall, 111 Elm St., according to the agenda.
Two FOIL appeals tied to a proposed annexation at 2442 Old Route 14A, also known as the former McFetridge Farm, are listed under other business.
One appeal seeks what the requester describes as the complete SEQRA administrative record for the annexation, including internal communications, consultant materials and technical studies supporting the village’s Negative Declaration.
A separate appeal challenges the village’s response to a FOIL request for electrical load, utility capacity and ratepayer impact records related to the same project. The appeal argues that portions of the request were denied too broadly and calls for additional records or redacted copies to be released.
Trustees will also consider Resolution No. 8-2026, which would authorize the mayor to execute an Undertaking Agreement with the New York State Department of Transportation.
The proposed agreement would govern how the village performs maintenance and repair work on its water, sewer, storm sewer and electric infrastructure located within state highway rights-of-way.
The draft resolution states the action would be classified as a Type II action under state environmental review regulations because it involves existing infrastructure and would not require further environmental review.
The agenda also allows time for public comments and includes the option for an executive session with legal counsel, if needed.
