Driver clocked at 80 mph faces DWI charge in Summerhill

A Sempronius man is facing a DWI charge after deputies say he was driving 25 miles over the speed limit with a blood alcohol content nearly three times the legal limit.

Clifton A. Payne, 48, was arrested around 9:40 p.m. on October 8 in the Town of Summerhill.


A Cayuga County Sheriff’s deputy spotted Payne’s vehicle going 80 mph in a 55 zone near Poverty Lane and Route 41A. After stopping the car, the deputy determined Payne was intoxicated.

Payne, who was the only person in the vehicle, gave a breath sample that registered a .23% BAC—well above the legal limit of .08%, and enough to trigger an aggravated DWI charge under state law.

He was processed at the Public Safety Building and released on tickets. He’s scheduled to appear in Summerhill Town Court on October 21 at 5:30 p.m.
